إدانة حالة التوقيف القسري للطبيب المصري / حسام عبدالفتاح توفيق

تُدين “مؤسسة عدالة لحقوق الإنسان – JHR” حالة التوقيف القسري التي تعرض لها الطبيب المصري/ حسام عبد الفتاح توفيق، أخصائي المسالك البولية بمستشفى حمد الطبي بدولة قطر، الذي تمَّ توقيفه صباح الخميس24/3/2016 م بمطار بومباي بدولة الهند، أثناء توجهه لحضور مُؤتمرٍ طبيٍ عالميٍ، ضمن وفد من المستشفى القطري، بناءً على دعوة رسمية من دولة الهند لحضور المؤتمر.
وقد تمَّ التوقيف من قبل السلطات الهندية بناءً على مذكرة من الانتربول على إثر حكم غيابي صادر ضده وُصف بمخالفته لمعايير المحاكمات العادلة أمام إحدى المحاكم المصرية، والمعروفة إعلاميًا بقضية الإعدامات الجماعية، والتي تحمل رقم 8473 لسنة 2013 جنايات مطاي بمحافظة المنيا، والتي اتضح للجميع أنها قضايا سياسية، وقد ألغت محكمة النقض المصرية هذا الحكم لما به من مخالفات قانونية.
وهي ذات القضية التي تعرضت لها كافة المنظمات الحقوقية وقتها بالنقد، وتناولها الأمين العام للأمم المتحدة في بيانٍ خاص.
وتهيب المؤسسة، دولة الهند، بعدم الدخول في المُعترك السياسي الحاصل في مصر من الحكومة المصرية الحالية ضد معارضيها، وأن تنأى بنفسها عن هذه المُمارسات القمعية.
وتُحمل المؤسسة دولة الهند أية أضرار تقع ضد المواطن المصري الطبيب / حسام عبد الفتاح توفيق.

‪#‎Condemnation‬
“Justice for Human Rights – JHR” Condemns the arbitrary detention of Dr. Hossam Twafik Mohamed, a physician working in the department of urology in Hamad Hospital Medical Qatar, specialized in urethral surgery and was invited officially among a delegation of the Qatari hospital to attend the urethral reconstructive workshop in Pune, India, during entering the country on Thursday, 03/24/2016, whereas Dr. Hossam was detained at Bombay Airport on the basis of
a memorandum of Interpol, following to a political judgment issued against him in absentia by an Egyptian court in Case No. 1824/2013 felony Matai, known in media “mass death sentences”.
Based on misapplying of the law, the Cassation court overruled the said judgment on 24th January, 2015, Case No. 20238/84 k and ordered the retrial proceedings before another circuit.
Several human rights organizations at the time and the Secretary General of the United Nations were criticized the said judgment for violating the international standards of fair trials.
The State of India is kindly requested not to engage in violations of human rights happening in Egypt and we are holding the Indian authorities full responsible for any damages sustained to the Egyptian citizen Dr. Hossam Tawfiq Abdel-Fattah.
